★司法修習生と睡魔との戦い★

　筆者の県の地裁にも，新しい期の司法修習生が７月から来ています。まだ実務修習が始まってから間がないので，緊張している様子はあるものの，それでも午後の法廷ではすごく眠たそうな様子がよくわかります。司法修習生って，そんなに眠たいものなのでしょうか？

　筆者が修習生だった頃を思い出してみても，やっぱり裁判の当事者でないのにひたすら裁判を傍聴するというのは，どうしても緊張感が保てないものです。また，事件の記録を全て読んで頭に入っていれば，いろいろなところに注意して傍聴できるので楽しいのですが，たとえば３ヶ月間の民事裁判の修習中に配属された部の全ての事件記録を読むのはほぼ不可能なので，どうしても記録を読んでいない事件も傍聴することになります。そうなると，いったい何を証言しているのかとか全くわからず，証言が子守歌にしか聞こえてきません。筆者も，丸一日証人尋問が開かれる事件で，記録をほとんど読んでいなかったとき（前日まで家庭裁判所修習があって，読めなかった），もうずっと苦痛な時間が流れたのを記憶しています。寝ないように左手の甲にペンを何回も突き刺して，その後１週間くらい左手が腫れていたのを記憶しています。また，眠くならない薬を飲んだり，昼食を食べ過ぎないようにしたりなど，みんなでいろいろ工夫をしあって，なんとか眠くならないように頑張っていました。

　ただ，眠くなるのは仕方ないにしても，やはり法廷は当事者達が裁判官の審理を求めて真剣に集う場。その場に修習のためということで特別にいさせてもらっている以上，当事者からみて不適切な態度をとるのは論外だと思います。
