★弁護士が気乗りしない事件①★

　ぶっちゃけ，「あー，こんな事件やりたくないなあ」と思うことって，やっぱりあります。でも，筆者のように田舎で弁護士が少ない地域では，自分が断ると他に頼める弁護士がいない，なんて状態になってしまうことがあるので，やりたくない事件でもやらなくてはならないことがあります。
　
では，できればやりたくない事件とはどんな事件でしょうか。

①ドロドロの離婚事件
　夫婦の一方が浮気をしていることが明らかだとか，そういう場合は比較的ラクですが，たいていの離婚はどちらにも非があるものです。そして，決定的証拠のある非は少ないので，お互い相手の小さな非をどれだけ多く主張するか，という争いになってしまいがちなのです。

たとえば，「妻が家事をしない」，「夫が子育てをしない」，とかならまだいいですが，「妻はお風呂のお湯を２日に１回しか変えさせてくれない」，「夫は体臭が臭すぎる」，「妻の母が毎週末遊びに来てうるさい」，「夫は脱いだ靴下を脱ぎ散らかしたまま」とか，それが果たして裁判で主張すべきほどの非なのかどうかよくわからない主張がたくさん出てくることがあるのです。
　
弁護士としては，「そんなの主張しても無駄だよ～」と思うのですが，依頼者の感情が大変根深いため，「先生，なんでこんなことやあんなことも裁判官に言ってくれないんですか！」と言われてしまい，ついつい無駄だと分かりつつもいらない主張をしてしまいがちなのです。

　筆者はまだ独身ですが，離婚事件をたくさん見ていると，結婚するのにかなり勇気が必要になりますねふらふら

東京の大学に通う２年生です。
ロースクール目指して勉強中です。とはいっても部活も遊びも色々やってるので、もっと勉強も頑張らなきゃと思ってます(>_<)
ここでは具体的な弁護士さんのお話が拝見できてとてもためになります。昔は都会の大きな事務所で働くような弁護士さんに憧れていたのですが、最近は弁護士過疎の問題についても気になっていて、町弁先生のような弁護士さんも素敵だなぁと思いました。これからも遊びに来たいと思いますのでよろしくお願いします☆

　勉強，遊び，部活，いろいろ頑張っていらっしゃって，すごく尊敬しちゃいます！筆者は勉強だけしかできない人よりいろいろな遊びやスポーツとかができる人の方が人間的にみて面白いと思います。ぜひぜひ，部活とかもおろそかにせず，ロースクール目指して頑張ってくださいね！

確かに法曹になるにしても個性があったほうがいいですよね。私とbig mouseさんは大学時代テニスしかしてなかったんですけど（おそらく）、テニスできることも立派な個性だと研修所で感じました。
気乗りしない事件といえば、僕は債権回収が苦手です。お金ないっていわれるのにそれでも払えっていうのはあんまりいい気分がしないですねぇ。なかにはお金持ってるのにないって言い張ってる人がいるのかもしれないけど。こういうときに特に弁護士って人間性が問われる仕事だなと感じます。
